The Ministry of Economic Development is preparing unscheduled inspections for tour operators.

Russian tour operators may face unscheduled inspections by the Ministry of Economic Development: a draft order has been published on the federal portal of draft regulatory legal acts, in which the agency outlines the grounds for inspection. at the maintenance work.

According to the document, tour operators' risks will be assessed on a five-point scale. If a company scores 5 or more points within a year, it may face an unscheduled inspection.

The agency is expected to analyze tour operators' financial performance. For example, they will look at whether they have incurred losses over a single year. If negative trends persist for several years, the risk will be considered critical.

The agency will also focus on tour operators with multiple legal entities. "The presence of identical or confusingly similar domain names in the Unified Federal Register of Tour Operators. The following values are used when assessing the risk: 1 point – the presence of three or more identical or confusingly similar domain names. This value applies to all tour operators whose Register information contains such domain names; 3 points – the presence of ten or more identical or confusingly similar domain names. This value applies to all tour operators whose Register information contains such domain names," the text states.

Therefore, if the document is adopted, at least one point will be lost to a number of major players. For example, the registry currently lists six Coral Travel legal entities with the same domain name (www.coral.ru).

In addition, points will be awarded for complaints from tourists received by the department, as well as for the absence of information on the TO website about the insurers on whose behalf the company concludes voluntary insurance contracts.

As explained to the TRN portal Georgy Mokhov, Ombudsman at the Office of the Commissioner for the Protection of Entrepreneurs' Rights in Moscow and head of the Persona Grata Law FirmThese criteria are rather conditional and insufficient for assessing the actual financial risks of tour operators. "This is a new system of state control based on a risk-based approach. When criteria for assessing a company's sustainability and the risk of harm to consumers are developed based on these indicators, unscheduled inspections are scheduled to prevent future bankruptcies. This system is currently only in draft form; we'll wait for the relevant regulations to be adopted," he explained.
